Loveless is in fact shouta because Soubi is an adult (I've seen his age listed as both 19 and 21) and Ritsuka is a sixth grader. However I have less of an issue with it because of a conversation between Ritsuka and Soubi in volume 1

In addition to that Ritsuka is extremely mature for a twelve year old (he was reading Nietzsche for crying out loud!) and even though Soubi is an adult and Ritsuka is underaged the nature of their relationship is not ***** because 1. Soubi although at the opposite end as Ritsuka, is in fact still adolescent and 2. Soubi likes Ritsuka because he's Ritsuka, not becuase he's twelve.
